What we collect when you use this website or make an enquiry, why we hold it, who else sees it, how long we keep it, and what you can ask us to do with it.
Who we are
Home Constructive is a building company working across south and west London. We are a limited company registered in England and Wales. Our company registration number is 09287521 and our registered office is at 65 Churchill Road, Uxbridge, London UB10 0FN.
For the purposes of UK data protection law we are the controller of the personal information described in this policy. That means we decide why it is held and what is done with it. If you want to raise anything covered here, the contact details are at the foot of the page.
This policy covers information collected through this website and through enquiries made to us by any route. Work carried out under a signed building contract may also be covered by terms in that contract; where the two differ on a point of data protection, this policy sets the minimum.
What we collect
Information you give us. When you use an enquiry form, request a site survey, email us or ring us, you choose what to tell us. In practice this is usually your name, an email address or telephone number, the address or rough location of the property, and a description of the work you are considering. Some people add drawings, photographs, planning references or a surveyor's report. We do not ask for more than the enquiry needs.
Information collected automatically. Like most websites, this one records limited technical information when you visit: the pages you look at, the approximate region you are in, the type of device and browser, and how you arrived. Some of this comes from cookies and similar technologies, which are described separately in our cookie policy.
Information from your project. If you go on to instruct us, we hold what the job requires — correspondence, site notes, drawings, photographs of the works, variations, invoices and payment records.
We do not knowingly collect information from children, and this website is not directed at them. We do not ask for special category data such as health information, and you should not send it to us unless it genuinely affects the work — for example an access requirement we need to design around.
Why we hold it, and our lawful basis
UK data protection law requires a lawful basis for every use of personal information. Ours are as follows.
- To answer your enquiry and arrange a survey. Basis: steps taken at your request before entering into a contract, and our legitimate interest in responding to people who contact us.
- To prepare quotations and carry out building work. Basis: performance of a contract with you, or steps taken before one.
- To keep records of work carried out, including photographs of completed projects. Basis: legitimate interests — defending our position if a question arises later about what was built and how.
- To meet legal and regulatory duties, including tax, health and safety, building control and insurance obligations. Basis: legal obligation.
- To understand how the website is used and improve it. Basis: your consent, given through the cookie banner, where the analytics we use rely on cookies.
- To show a completed project on this website or in marketing. Basis: your consent. We ask separately, and a project can be shown without naming you or giving the full address.
We do not sell personal information, we do not share it with anyone for their own marketing, and we do not make decisions about you by automated means.
Who else sees it
We share personal information only where there is a reason to, and only with the part of it that is needed.
- Suppliers who run our systems — the platform that hosts this website, our email provider, our analytics provider, and the software we use for quotations and accounts. They act on our instructions.
- Professionals working on your project, such as architects, structural engineers, party wall surveyors, building control bodies and specialist subcontractors. We pass on what they need to do their part, and no more.
- Our accountants, insurers and, if it were ever necessary, our legal advisers.
- Public authorities where the law requires it, including HMRC and local authority building control.
Some of these providers operate outside the United Kingdom. Where information is transferred abroad, we rely on the UK Government's adequacy regulations for that country, or on the International Data Transfer Agreement or Addendum, so that the protection travels with the information.
If our business were ever transferred to another owner, records would pass with it, and anyone affected would be told.
Cookies and analytics
This website sets a small number of cookies. Some are strictly necessary for the site to load, stay secure and remember what you have chosen in the cookie banner; these are set without consent because the site cannot work without them. Others are analytics cookies, which tell us in aggregate which pages people read and where they leave. Those are set only if you agree.
Analytics reports are read at the level of the audience rather than the individual. We use them to work out which guides are useful and which pages fail people, not to identify visitors.
Our cookie policy sets out the categories in full and explains how to change your mind at any time, in the banner or in your browser.
How long we keep it
We keep personal information for as long as there is a reason to, and then delete it.
- Enquiries that do not become projects: two years from the last contact, then deleted. People often come back a season or two later, and it saves them repeating themselves.
- Project records, contracts and correspondence: six years after the work is completed. That is the period in which a claim under a simple contract can normally be brought in England and Wales, so it is the period in which we may need the record to defend or explain what was done.
- Accounting and tax records: for the period HMRC requires.
- Photographs used with your consent: until you withdraw that consent, after which we stop using them and remove them from the website at the next update.
- Website analytics: for the limited period set in our analytics account, after which the underlying records expire automatically.
How we keep it safe
Information is held on business systems protected by access controls and encryption in transit, with access limited to the people who need it to do their job. Our website is served over a secure connection. Paper records, where they exist, are kept securely and destroyed when their retention period ends.
No system is perfect, and we would not claim otherwise. If a breach occurred that was likely to result in a risk to anyone's rights, we would report it to the Information Commissioner's Office within the time the law allows and tell the people affected where the risk to them was high.
Your rights
Under UK data protection law you can ask us to do any of the following, free of charge in almost all cases.
- See what we hold about you, and get a copy.
- Correct it if it is wrong or incomplete.
- Delete it, where we no longer need it and no legal duty requires us to keep it.
- Restrict what we do with it while a question about it is being resolved.
- Object to our use of it where we are relying on legitimate interests, and to any direct marketing at any time, without giving a reason.
- Receive it in a portable form, or have it sent to someone else, where we hold it by consent or under a contract and it is held electronically.
- Withdraw consent at any time where consent is our basis. That does not affect anything done before you withdrew it.
Ask by writing to the contact details below. We will respond within one month, and will tell you if we need longer because the request is complex. We may ask you to confirm who you are before we release anything.
If you are not satisfied with how we have handled your information, you can complain to the Information Commissioner's Office, the UK regulator, at ico.org.uk, or by post or telephone using the details published on that website. We would rather you came to us first so that we have a chance to put it right.
Changes to this policy
We update this policy when the way we work changes or when the law does. The current version is always the one published here, and the date it was last reviewed appears at the foot of the page. If a change materially affects how we use information you have already given us, we will tell you directly rather than relying on you to notice.
